1.1 Introduction and Legal Entity

These Terms of Service ("Terms") govern your use of the service located at https://emailx.ai ("Service"). The Service is operated by Julien Paltrinieri, Partita IVA 14364730961 (referred to herein as "Emailx," "we," "our," or "us"), a Ditta Individuale (Sole Proprietorship) registered in Italy.

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (collectively, the "Agreements").

1.3 Eligibility and Changes to Terms

You must be at least 16 years old and legally permitted to use the Service under the laws of your country. We may modify these Terms at our sole discretion. We will notify you of material changes by posting an updated version on the Website or by email. All changes shall become effective upon posting or notification.

2. Scope Usage, Data Handling, and Prohibited Uses

2.1 Use of Google API Data (Critical for Verification)

The core functionality of Emailx involves connecting to your Google (Gmail) and LinkedIn accounts to provide AI-powered email personalization, drafting, and campaign management.

By connecting these accounts, you grant us access to your data via specific scopes:

  • Gmail API Scopes (gmail.readonly, gmail.send): This access is strictly limited to analyzing your email content and metadata to generate personalized draft responses and to send emails on your behalf from the Emailx interface, solely to provide the Service's user-facing features.

Google API Services User Data Policy Compliance: Our use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. We will not use, transfer, or sell data obtained from Google APIs for serving advertisements, creditworthiness determination, or any unauthorized purpose.

2.2 Prohibited Actions and Spam Policy

You agree not to use the Service in any way that is unlawful, prohibited, or violates these Terms. Prohibited actions include:

  • Misuse of API Data: Selling, transferring, or otherwise misusing data obtained from Google APIs (including Gmail or LinkedIn) for purposes other than providing the core functionality of Emailx.
  • Spam & Unsolicited Email: Emailx is NOT designed for sending unsolicited commercial email. Users must only communicate with contacts they own or with whom they have an existing legitimate business relationship. Users are solely responsible for ensuring recipient consent. You must comply with the U.S. CAN-SPAM Act, the GDPR, and all applicable anti-spam and privacy laws. Emailx provides an unsubscribe feature to help maintain GDPR and CAN-SPAM compliance.
  • Reverse Engineering: Attempting to reverse engineer, decompile, or disassemble the Service.
  • Data Mismanagement: Collecting, processing, or managing sensitive information (e.g., health records, financial account numbers, unencrypted passwords).

2.3 User Responsibility

You are solely responsible for all content, data, and emails sent through your account. Any breach of this section will be considered a material breach and grounds for immediate termination.

3. Fees, Subscriptions, and Payment Terms

3.1 Pricing Overview

EasyPersonalize offers flexible pricing options to suit different usage needs:

  • Free Trial: 30 free email credits upon registration
  • One-Time Credit Packages: Pay-as-you-go credits without recurring charges
  • Monthly Subscriptions: Recurring plans with included monthly credits and additional features

Pricing is available in both EUR (€) and USD ($). The currency charged will depend on your location and payment method.

3.2 One-Time Credit Purchases

You may purchase email credits on a one-time basis without a subscription. Available packages include:

  • Up to 50 emails: €7.00 / $8.20
  • Up to 100 emails: €12.00 / $14.00
  • Up to 500 emails: €49.00 / $57.00

One-time credits do not expire but are non-refundable once purchased. These credits include access to core email features only.

3.3 Subscription Plans and Billing

Subscriptions are billed on a recurring monthly basis ("Billing Cycle"). By subscribing, you authorize us (or our third-party payment processors) to automatically charge the applicable subscription fee to your chosen payment method at the beginning of each Billing Cycle.

Available subscription plans:

  • Starter Plan: €29.00 / $34.00 per month, includes 500 email credits per month, AI research and personalization, and campaign analytics (€0.058 / $0.068 per email)
  • Growth Plan: €59.00 / $69.00 per month (regularly €79.00 / $92.00), includes 2,500 email credits per month, AI research and personalization, advanced analytics, custom email templates, 5,000-word knowledge base, email quality check, plus bonus: The 2025 Email Productivity Guide (valued at €97 / $97) (€0.024 / $0.028 per email)
  • Scale Plan: €199.00 / $232.00 per month, includes 10,000 email credits per month, AI research and personalization, advanced analytics, custom email templates, unlimited-word knowledge base, email quality check, guardrail system, advanced AI campaign optimization, plus bonus: The Email Communication Optimization System (valued at €247 / $247) (€0.019 / $0.023 per email)

Monthly subscription credits reset at the beginning of each Billing Cycle and do not roll over to subsequent months. Unused credits from a given month expire at the end of that Billing Cycle.

3.4 Overage Charges

If you exceed your allotted email credits—whether under the Free Trial, a one-time credit package, or a monthly subscription—you will automatically be charged €0.12 / $0.14 per additional email. These overage charges will be billed immediately or added to your next invoice, depending on your payment method. By using the Service beyond your included credits, you authorize us to charge these overage fees automatically.

3.5 Free Trial

We offer a Free Trial consisting of 30 free email credits with access to core email features. The Free Trial is available to new users only and may be subject to verification. If you subscribe to a paid plan before exhausting your Free Trial credits, those free credits will be forfeited, and your paid subscription will begin immediately. If you do not subscribe and exceed your Free Trial allocation, overage charges as described in Section 3.4 will apply.

3.6 Payment Methods and Currency

We accept payment via credit card, debit card, and other payment methods made available through our third-party payment processors. Prices are displayed and charged in either EUR (€) or USD ($) based on your location, billing address, and payment method. Currency conversion rates, if applicable, are determined by your payment processor or financial institution and may include additional fees.

You agree to provide current, complete, and accurate payment information and to promptly update your payment method in the event of expiration, cancellation, or change. If a payment fails or is declined, we reserve the right to suspend or terminate your access to the Service until payment is successfully processed.

3.7 Price Changes

We reserve the right to modify our pricing, including subscription fees, one-time credit packages, and overage rates, at any time. Any price changes for subscription plans will take effect at the start of your next Billing Cycle after we provide you with at least 30 days' advance notice. If you do not agree to the new pricing, you may cancel your subscription before the new rates take effect. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

3.8 Taxes

All fees are exclusive of applicable taxes, duties, or similar governmental assessments, including value-added tax (VAT), sales tax, or use tax (collectively, "Taxes"). You are responsible for paying all Taxes associated with your use of the Service, except for taxes based on our net income. If we are required to collect or pay Taxes, they will be charged to you in addition to the stated fees.

3.9 Refunds

All purchases of usage credits, one-time credit packages, overage fees, and subscription fees are final and non-refundable. We do not offer refunds for partial subscription periods, unused credits, or any other reason, except where expressly required by mandatory Italian or European Union consumer protection law. 3.10 Cancellation and Downgrade

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of your current Billing Cycle, and you will retain access to your subscription features and remaining credits until that date. No refunds or prorated credits will be issued for early cancellation. If you downgrade from a higher-tier plan to a lower-tier plan, the change will take effect at the start of your next Billing Cycle, and any unused credits from your current plan will be forfeited.

4. Termination and Liability

4.1 Termination for Cause

We may terminate or suspend your account access immediately, without prior notice or liability, for Cause, including but not limited to:

  • Breach of Section 2 (Prohibited Actions and Spam Policy).
  • Failure to pay any fees when due.
  • Violation of any material term of these Agreements.

4.2 Effect of Termination

Upon termination, your right to use the Service will cease immediately. If your account is terminated for Cause by Emailx, you will promptly pay all unpaid fees due through the end of the subscription term, and you will not be entitled to a refund for any prepaid fees or unused credits.

4.3 Limitation of Liability

To the maximum extent permitted by applicable law, Emailx shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. This limitation of liability does not exclude or limit our liability for losses that cannot be lawfully excluded or limited under mandatory Italian or EU consumer protection law.

5. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of laws principles.

You and Emailx irrevocably consent to the exclusive jurisdiction of the courts located in MILANO, ITALY for any action arising out of or relating to these Agreements.
